Parents’ Bill of Rights for Data Privacy and Security

The following Parents’ Bill of Rights is provided pursuant to New York State Education Law §2‑d. As a third-party contractor working with New York school districts, SOAR Learning adheres to the protections outlined below and complies fully with all associated privacy and security requirements. Parents (including legal guardians or persons in parental relation to a student), and eligible students (those over age 18), are entitled to the following rights regarding student data privacy and security:

1. Prohibition on Commercial Use

A student’s personally identifiable information (PII) cannot be sold or released for any commercial purpose.

2. Right to Inspect and Review Records

Parents have the right to inspect and review the complete contents of their child’s education record maintained by the educational agency. Eligible students also have this right.

3. Data Privacy and Security Safeguards

State and federal laws protect the confidentiality of student education records, and safeguards such as encryption and password protection are in place to protect student data.

4. Parental Complaints

Parents have the right to file complaints with the school district or educational agency if they believe their child’s PII has been disclosed improperly.

5. Data Collection Disclosure

A complete list of all student data elements collected by the State Education Department is available upon request. Parents may also request information about the purpose of such data collection.

6. Third-Party Contractor Requirements

Contracts with third-party contractors that receive student data must include data security and privacy protections, and must be consistent with the school district’s policies and applicable laws.
